Arbitration involving the concession agreement for Line 2 of Metro de Lima

We advised the international consortium awarded the concession agreement for Line 2 of Metro de Lima on its claim against the Republic of Peru, covering the pre-arbitration negotiation phase until the international arbitration phase conducted by ICSID (amount over USD one billion).

Our client is the international consortium awarded the concession agreement for Line 2 of Metro de Lima, made up of some of the world’s leading construction and engineering groups: ACS Group, FCC Group, Salini Impregilo (currently Webuild), Cosapi and Hitachi Group.

The project involves implementing a 35-km long underground subway line in Lima city, which is one of the largest and most complex works in the history of Peru, with an estimated initial investment over USD 5.3 billion. It is also the first metro line using underground heavy rail to be implemented in Peru, with the added complexity that it is an automated metro system (no driver).

It is a comprehensive project in which the concessionaire is responsible for designing, financing and building the project; providing electromechanical equipment, system equipment and rolling stock; and operating and maintaining the project.
