Act 2/2023 regulates the protection of persons who report regulatory infringements and the fight against corruption, transposing Directive 2019/1937, better known as the "Whistleblowing Directive." The Act will enter into force on March 13.

The main novelty is that it establishes the obligation for companies with 50 or more employees to implement a reporting system, while ensuring the protection of whistleblowers (not necessarily employees). Companies have a few months to adopt new reporting systems and coordinate these channels with other internal protocols, codes and policies they may have.

In the following Legal Flash, prepared by the Cuatrecasas Knowledge and Innovation Area, you will find a summary of the main aspects of the regulation, which companies are affected, the scope, content and requirements of whistleblowing channels, who is responsible for managing them, and the protection granted to whistleblowers.
