The Ministry of Health has launched the public hearing process for the future Reference Price Order (OPR) for 2026. From its official publication, interested parties will have a period of 15 business days to submit any comments or observations they consider appropriate.

Key points

  • Application of the CIPM’s new powers: The main new feature this year is the inclusion of a specific annex for medicinal products that, by decision of the Interministerial Committee on Medicine Prices (CIPM), are exempted from the Reference Price System or are subject to increase coefficients.

    • This measure is the direct result of the amendment to Article 98 of the Royal Legislative Decree 1/2015, introduced by the Law creating the Public Health Agency —Law 7/2025—.
    • The aim is to ensure the supply and economic viability of critical medicines or medicines at risk of shortage. 
  • Configuration of groups: The draft provides for the creation of 26 new groups, distributed as follows: 14 for community pharmacies, 11 in the hospital setting, and 1 for clinical packs. At the same time, it proposes the removal of 19 existing groups.

This process represents a key opportunity for companies in the sector to assess the impact on their portfolios and submit their observations to the Directorate-General for the Common Portfolio of National Health System Services and Pharmacy.
