The judgment delivered by the Court of Justice of the European Union (CJEU) on 27 February 2025 in the case CK v Magistrat der Stadt Wien and Dun & Bradstreet Austria GmbH represents a landmark interpretation of the General Data Protection Regulation (GDPR) in the context of automated decision-making and profiling particularly where such processes intersect with the protection of trade secrets.

The Court was called upon to clarify the scope of the right of access to ‘meaningful information about the logic involved’ in automated processing under Article 15(1)(h) of the GDPR, and to determine how this right should be balanced against the legitimate interests of controllers in protecting trade secrets and the rights of third parties.
