On June 2, 2025, an ad hoc Committee ("Committee") constituted under Article 52 of the Convention on the Settlement of Investment Disputes between States and Nationals of Other States dated March 18, 1965 ("ICSID Convention" or "Convention") rendered its Decision on Annulment1 ("Decision") regarding the Award issued in Rockhopper v. Italy in 2022 ("Award").

In the Decision, the Committee unanimously found that the lack of disclosure by one of the arbitrators ("Arbitrator") of his criminal conviction and later acquittal in Italy decades before being appointed as member of the tribunal by the claimants in that case qualified das an improper constitution of that tribunal and, consequently, annulled the Award in its entirety pursuant to Article 52(1)(a) of the Convention at Italy’s request.
