SubscribeThe CNMC has authorised with commitments, following a second phase investigation, the merger of two of the three largest operators in the Spanish home respiratory therapy market.
During its investigation, the CNMC concluded that the transaction resulted in a significant alteration of the market structure and increased the likelihood of coordinated conduct among the main market operators, as this is a market in which virtually all demand (94%) is channeled through public tenders.
Oximesa submitted a package of commitments, most notably capping increases in the prices of home therapy services to the CPI (consumer price index). Finally, in February 2026, the CNMC authorized the concentration, having deemed those commitments sufficient to address the identified competition concerns.
