SubscribeThe new electric mobility regime (“RJME”), approved by Decree-Law 93/2025 of August 14 (see Guide to new electric mobility regime), was recently supplemented by several development and implementing ordinances. In March, the following ordinances were published in the Official Gazette of the Republic of Portugal:
- Ordinance 118/2026/1 of March 19, establishing the terms of the mandatory civil liability insurance for charging point operators. It also sets the annual minimum coverage amounts, which depend on the charging points’ characteristics, size and associated risk level. The insurance covers the obligation to compensate third parties for any damage arising from the operator’s acts or omissions in performing its activity.
- Ordinance 128/2026/1 of March 26, establishing the minimum charging power and technical rules applicable to the installation and operation of electric-vehicle (“EV”) charging points (“EV”), as provided for in article 22 of the RJME (i.e., for charging points in condominium buildings and other structures with parking facilities).
- Ordinance 130/2026/1 of March 27, establishing the terms applicable to private-use licenses for installing EV charging points in public spaces. The private-use license for installing charging points in public spaces is granted for a period not exceeding the charging point operator’s operating license. Also, it expires automatically upon the expiration of the operating license, and it may be transferred only with the issuer’s authorization. The ordinance delegates to the pertinent entities the power to set the procedure’s terms. Specifically, those entities are either the owners of the public-domain assets or the entity tasked with managing them.
- Ordinance 133/2026/1 of March 30, setting the fees payable for (i) submitting and processing the prior notice (€1,000); (ii) applying for the charging point operating license to be issued (€1,000), including in cases of tacit approval; and (iii) conducting periodic inspections (up to €200).
